Remarks regarding the conditions of pre-trial arrest

Summary/Abstract: The new Criminal code, unlike the old one, does not provide a limit under which the measure of pre-trial arrest can not be applied. This lead to the wrong conclusion of some authors that pre-trial arrest can be applied to any crime, without distinction between a first time offense and repeat offense.
