Summary/Abstract: The article analyzes the problems of property rights recognition as a subject of the contract of sale in Ukraine. We investigate the characteristics of property rights, analyzes the risks of the parties at the conclusion of such agreements. Author analyzed the legal consequences of failure or improper sides fulfillment in the sale contract to full completion. Grounded suggestions for improving the legal regulation mechanism of the violated side’s rights.
