Summary/Abstract: The innovation of Law no. 25/2012 (dated from 13th March 2012) lies in regulating the Restraining Order establishing measures such as legal obligations or restrictions for a person who exercise violence on family members. Considering that measures or restrictions which could be taken under the Restraining Order are real Criminal Law sanctions, this order cannot be delivered for any form of domestic violence (e.g. spiritual violence, verbal abuse), yet it is binding for the actions or inactions of the offender to constitute breaches of the application of Criminal Law.
