Summary/Abstract: The conclusion of the donation contract will be analyzed in the present study both from the perspective of the conclusion of this contract between the present persons and the hypothesis of its conclusion between the absents. We have highlighted the particularities of concluding the donation contract in both hypotheses, the sanctions in case of non-observance of the form required by law, with the exceptions expressly regulated, and the final part was dedicated to the analysis of the donation promise, a novelty brought by the Civil Code.
