Summary/Abstract: The article discuss problems of planning procedures in location in commune area which in Authoress opinion may be a barrier in technical, economic and market potential use of wind energy in Poland. Despite growing number of wind farms in Poland and enforcement of obligations imposed by the European Union, legal procedures associated with their location are seen by investors as a barrier in wind energy development. Data defining technical and economic potential of wind energy shows that Poland use energy in a small part. For many years, experts have been pointed out the need of using the wind energy occurring in many regions in Poland, which can protect our country from the energy crisis associated with the depletion of existing energy sources. Elaborate in this article legal aspects of wind turbines location may affect negative in the commune site and domestic wind energy development, making impossible to achieve expected gaining of national and regional economy.
