The Functions of Special Services of the Republic of Poland in the Light of Legal Regulations

Summary/Abstract: Służby specjalne stanowią tradycyjny i istotny element systemu bezpieczeństwa państwa, którego funkcjonowanie w warunkach demokratycznego państwa prawa oparte jest o zespół legislacyjnych upoważnień i ograniczeń. Celem niniejszej publikacji jest analiza ustawowych zadań polskich służb specjalnych pod kątem wyabstrahowania funkcji, jakie są przez nie realizowane w systemie bezpieczeństwa. Ustawy kompetencyjne tajnych instrumentów bezpieczeństwa definiują obszary ich zainteresowań i nakładają na nie bloki zadań, na podstawie których można mówić o wykonywaniu przez służby funkcji informacyjnej, kontrolno-ochronnej i procesowej.(abstrakt oryginalny) Special services constitute a traditional and important part of the system of state security which, when functioning under the democratic rule of law, is based on a set of legislative authorizations and restrictions. The aim of hereby publication is to analyze the statutory tasks of the Polish special services as regards the abstracting functions which are implemented by the services within the security system. The act on competence of secret security instruments defines the areas of their interests and impose the blocks of tasks on these entities on the basis of which one can discuss the performance of information, control-protection and process functions by the services.
