Strict tort liability: economic analysis

Summary/Abstract: The paper represents analysis of strict tort liability i.e. tort liability which is independent of fault. The economic ratio and allocative effects of such a regime are examined.As a conclusion it is stated that preventive effect of strict liability does not differ from the same effect of fault-based liability; but, unlike the fault-based liability, regime of strict tort liability not only induces to take reasonable precautions, but also ensures that social utility of the activity will be positive.
