Summary/Abstract: In 2003, through constitutional review, the Romanian Constituent inserted in the fundamental law preamble the conclusion that the Romanian people, in its political manifestation core, is in possession of democratic traditions. As enthusiastic this statement can be, as such it can prove questionable in truth. In this study, we will try to underline, through a brief exploration of the history of the Romanian constitutionalism, the fact that the Romanian democracy is rather a desideratum aimed basically in a declarative way, being placed in a form of a talisman against a past that awakens, also in a declarative way, a repugnance against power personalization, against an authoritarian chief of state. In this fund, art. 1 par. (3) of the Constitution reveals elements that translate traditional Romanian democracy paradoxes.
