System reformation of a structure and the content of the telecomunication legislation of Ukraine

Summary/Abstract: Problem setting. The active implementation of innovative technologies in the telecommunication sector conduced to the formation of a new type of the world economy. Information, quality of telecommunication networks, and their accessibility are key factors of the world economy competitiveness. Recent research and publications analysis. Issues of the development of economic and legal support of telecommunication relationships were, to a certain extant, considered in the economic and legal and civil and legal sciences, namely in dissertations of K. O. Kalachenkova, O. A. Bahutskyi, A. S. Peshkova. Paper objective. The article objective is to improve the content of the telecommunication relationship legal support in Ukraine on the basis of systematization of normative acts in this sector. Paper main body. The telecommunication complex legal support is provided by the Law of Ukraine «On Telecommunication» of 2003. Nevertheless, this Law does not sufficiently take into account public, corporate, and private interests in this sector. In addition, some markets and technical measures of signal transfer were not taken into consideration by the domestic legislation at all. Conclusions of the research. The author has suggested a three-level system of the legislation support for the legal regulation in the telecommunication sector, which includes: 1) general frameworks of functioning of the national telecommunication system of Ukraine, which can be approved and regularized through the confirmation of the Telecommunication Code of Ukraine; 2) some types of telecommunication services through the creation of a system of certain laws regulating special subjects cohered with respective statements of the Telecommunication Code of Ukraine; 3) particularization of the regulation of certain telecommunication services or peculiarities being within a scope of respective sub-legislative normative and legal acts.Short Abstract for an articleAbstract.
