Administrative Action in the Public Interest in the Context of European Law

Summary/Abstract: This paper deals with the active right of action in the context of administrative action in the public interest, specially according to § 66 par 4 of the administrative procedure code. The author deals with its evolution in relation to environmental law. The influence of some European directives and jurisprudence of the European Court of Justice is here very evident. In the conclusion of this paper the author suggest possible solutions to these problematics de lege ferenda.
