The offence of omission to notify the authorities in the new Criminal Code

Summary/Abstract: In the present paper, I have analysed the crime of omission to notify the authorities according to the law in force. Also, to highlight the evolution of the Romanian criminal law system, I have analysed the provisions regarding the aforementioned offence from three different perspectives – three different Criminal Codes (the Carol II Criminal Code, the 1969 Criminal Code and the Criminal Code in force). In order to provide support for practitioners, I have highlighted the elements that stand both as similarities and as differences with regard to the legal content of the offence, a scrutiny that is essential in order to identify and apply the more favourable criminal law in transitory situations. This study may be useful for bachelor and master students in Law Schools within the country, as well as for practitioners in the area of criminal law. The novelties consist in the examination carried out, as well as in the opinions expressed regarding the doctrinal interpretation of the elements of the objective side of the offense.
