Summary/Abstract: The loss reimbursement institute is an important means of protection of the private property rights if those are violated. The institute of loss belongs to feld of the liability law, which is one of the major felds of civil law.The Civil Law provides for certain types of losses – the one sustained, expected, direct, indirect and accidental loss. Although articles 1770 - 1775 of the Civil Law provide the defnitions for each type of losses, there are different interpretations of these articles in practice and in lawyers’ opinions, which brings about certain legal consequences.The article “Types of losses in Civil Law and their determination problems” analyses the types of damages as related to the explanation the law provides and current law enforcement practice in court judgments.Although for certain legal issues an established judicial practice exists, the majority of cases the opinions differ as concerns the type of loss to be defned.
