Summary/Abstract: The article focuses on the right to avoid the contract under the CISG. It explores the concept of fundamental breach and its application to cases of seller’s as well as buyer’s breach. Limits of the right to avoid such as notice requirement, time limits and restitution of the goods are also discussed.
