Summary/Abstract: This subject deals with the issues significant both from a theoretical and practical point of view. The issue concerns the topic regarding a new system that examines trademark applications - appli-cable from 15 April 2016 - also known as the opposition system, which greatly simplifies and speeds up the processing of applications for the right to protect a selected trademark. In presenting the issues above, it was necessary for this subject to preceded all of this by other considerations about basic issues related to the institution of the trademark. There were pointed the most important advantages of registration of name / logo as trademark, forms in which their legal registration should occur, as well as the extent of its territorial protection. A kind of brace holding together previously presented objects is a summary that in-cludes conclusions from the analysis, and an indication of how to protect the name / logo of the company in the absence or failure of a trade mark registration process. Subject should be regarded as accurate and fully justified because it is - in the field covered – a truly novel subject under the Polish law.
