Summary/Abstract: The article focuses on the important practical issue on the competence of the Commission for the protection against discrimination to request the Court of the EU to give preliminary rulings, on the example of the case “Belov”. The conclusion is made on the heterogeneous case-law of the Court and an approach case-by-case.
