Summary/Abstract: Public procurements play an important role in the national economies of the member states of the European Union. Besides public tenders that involve public entities have a high criminogenic potential for many reasons. Both the Polish and the German legal orders use mixed solutions of antitrust law and criminal law to fight illegal cartels including their special type – bid rigging. The article is the result of a comparative analysis of the Polish and German criminal law provisions which criminalize bid rigging (Article 305 of Polish Penal Code and § 298 of the German Penal Code).
