Summary/Abstract: The article brings into discussion the concept of the new law of criminal procedure according to which in most of the cases the appeal is the only effective and devolutive remedy against the judgment of the first court instance and tribunals. It is emphasized that this new regulation has dramatically changed the course of the trials begun under the old Code, with the consequence that the rulings on appeal became final and executory, causing immediate incarceration of persons sentenced to imprisonment.
