Summary/Abstract: The article aims to give a brief analysis of the right to education in Albania in the period from 1920 up to 1939, by firstly presenting an overview of the historical aspects in order to understand their influence on the right to education during the formation of the Albanian State. Education in Albanian in the period of 1920-1939 had the same characteristics the Albanian State: fragile and immature.The situation of the country in general and of education in particular was very difficult after the First World War. Severe shortages in school buildings and teaching material, shortage of teachers with appropriate education, as well as a lack of appropriate plans and educational programs needed for the foundation of the teaching process, were all missing components in the right to education in Albania. During this period, in formal legislative terms, the legal provisions in the field of education were beginning to cover various aspects of the activity of the school in detail, as well as the components of the educational system. It should be said that, regardless of the efforts of governments for drafting a variety of legal provisions, they do not imply any serious commitment on the part of the government to respect and implement the fundamental rights of its citizens. They were formal, at a time when political rights can be considered quite lukewarm, without the realization of which the adherence of fundamental rights and individual freedoms cannot be discussed. The state did not consider the recognition of the right to education by the state for all its citizens. Because of its weakness and the difficult economic situation, the Albanian state in this period of time failed to consistently sustainably, equitably and nationally offer the right to education.
