CONTRAVENTIONS TO THE LEGAL REGIME OF FUNERAL SERVICES SANCTIONED WITH THE ANNULMENT OF THE OPERATING SANITARY PERMIT (I)

Summary/Abstract: The Romanian Decision no. 741 from the 12th of October 2016 regarding the implementing rules of the Law no. 102 from the 8th of July 2014 on cemeteries, human crematoriums and funeral services incriminates certain facts which are punishable as contraventions. This short overview has as primary objective the identification and presentation of some facts considered by the current legislation as being contraventions to the legal regime of funeral services, burial, cremation, transport, exhumation and reburial of human corpses, cemeteries, human crematoriums, and also the professional criteria that must be met by the funeral services providers. Our interest concerns not all the facts considered contraventions, but only those which are also sanctioned with the annulment of the operating sanitary permit of the funeral service provider. As secondary objective, we'll put forward some de lege ferenda proposals on the legal framework that ensures the protection of public health in the field of funeral services.
