Summary/Abstract: The right of perpetual usufruct is regulated in two effective normative acts: Civil Code as well as the Real Estate Management Act from 21st August 1997. The right of perpetual usufruct was introduced in 1961 with the Act on Urban Land Management. In accordance to the present understanding the right of perpetual usufruct is an indirect law between ownership and a limited property right. This right is the form of a paid, long-term use of the land belonging to State Treasury or to the units of local government units or related organs. The validity of keeping the right of perpetual usufruct as a legal tool has been the subject of numerous debates in Poland for many years. This article is devoted to the characteristic of this kind of ownership.
