The rules for creating constituencies for the conduct of elections to municipal councils, county councils and regional assemblies in Polish Third Republic

Summary/Abstract: Considerations presented in the article entitle to claim that the procedure for allocation of lo-cal government units in the constituencies is formalized and exceptions from those rules are not possible. Any deviation from the presented procedure should be considered as a violation of the law and does not deserve approval. Issues presented in the article are momentous from the point of view of widely understood social justice. It cannot be accepted a situation in which the division of community constituencies and the number of councilors elected in constituencies will be deter-mined by the council in isolation from the presented rules. Therefore, both the governor as the su-pervisory authority over local government units as well as electoral commissioner, who is a per-manent organ of the election, should in any case ofcarrying out activities related to the sharing of local government units of constituencies, to make deep analysis of personalized actual status with current legal status. It should also be considered,that voters themselves can make such control through the introduction of the electoral legislation in criminal proceedings institutions constituencies.
