EUROPEAN CIVIL JUSTICE – ACHIEVEMENTS AND CHALLENGES

Summary/Abstract: In this text the author makes a review of a period of less than 20 years marked by the approval of a set of legal tools that changed the face of the Justice Administration in the European Union; it refers the clear cut with the past that happened during those years, especially through the crucial suppression of the exequatur and of the systematic intermediation of central authorities; it points out the decisive institutionalization of the direct communication between the European Courts; it shows how private international law measures are required to support the free movement of citizens; it refers the movement in the direction of the establishment of an area of freedom, security, and justice through the adoption of measures in the field of judicial cooperation in civil matters; it deals with the broad framework of legal rules established during that period making reference to the important role of the European Judicial Network in civil and commercial matters; it gives an insight on the future development of the European civil law with special reference to the access to justice, the principle of mutual recognition of judicial and extrajudicial decisions in civil matters, the international jurisdiction, the applicable law, the recognition and enforcement of foreign judgments, the use of technological means – especially videoconference – the direct taking of evidence, the direct communication between courts, the systematic use of informatics for the performance of the cooperation task and the training of the legal professionals – particularly judges and lawyers; it also has incidence on the next recommendable great objectives of the EU and the technical areas needed to be covered.
