Summary/Abstract: Professional ethics is an important aspect of each profession. When we take a look at the legal sources of the professional ethical conduct, we see that the ethical code, as a form of soft law regulation, is becoming increasingly important. Professional codes of ethics are important from historical and traditional perspective as a form of the autonomous regulation in the certain professions. However, they have progressively important role today as a legal instrument in the process of harmonizing national laws with the European and the international standards, due to the flexibility of its norms to the contemporary and rapid social and legal developments. One of the most important professions in a society and a legal system of a country is judicial. This paper examines legal and ethical aspects of the relevant domestic (Serbian) legislation and soft law and their compliance with the international and the European codes and ethical standards, with the reference to the historical roots of judicial ethics. The article demonstrates temporal and territorial significance of the code of judicial ethics through the history and today, on the level of our country, Europe and the whole world, but also points out the particular importance of judicial ethics.
