Some controversy in the field of the plea of illegality in the light of Law no. 554/2004 on administrative litigation

Summary/Abstract: In the study hereby the authors debate upon some controversial subjects - occurred in doctrine and jurisprudence – related to the correct meaning of purport of Art. 4 (1) of Law no. 554/2004 (on administrative litigations), a purport which provides that the legality of an individual unilateral administrative deed, regardless of the date of its issue, may be examined at any time, in a trial, by way of exception, ex officio or at the request of the interested party.
