Summary/Abstract: The article aims to undertake a detailed analysis of the new provisions of art. 741 in the Criminal Code, recently brought in in the Criminal Code by Law no. 202/2010 regarding some measures to accelerate disputes resolution. There are dealt with issues concerning the legal nature of art. 741 in the Criminal Code, as well as their conditions of application, being of particular importance in their implementation as regards criminal cases investigated by judicial bodies.
