Summary/Abstract: The article presents and discusses public procurement, which may be a factor supporting innovation. The text also points out that innovative procurement promotes innovation, as well as it can be an important factor in the development and functioning of businesses and a way to increase their profits.First, the ambiguity of the definition of the concept of innovation in the literature was described, then the concept of innovative procurement (deliveries, services and innovative construction) was defined. A study showed that innovative public procurement should not only be defined as procurement for an innovative supply, a service or a construction work, but also for those in which the procuring entities use new processes and modes of public procurement. The use of new technologies, improved production systems and enterprise management are the key to implementing innovative procurement. This approach was also indicated by public procurement market participants surveyed by the Polish Agency for Enterprise Development.Innovative modes of public procurement such as negotiation with announcement, negotiation without announcement, competitive dialogue and new mode of innovation partnership were presented and discussed. The presented modes of public procurement are modes that are likely to support innovative activities. The article stresses that, despite promoting the modes of innovative procurement in recent years, unfortunately their use leaves much to be desired. Mainly, the success of these modes will depend not on their promotion among the contracting entities and the contractors, but on the real needs for innovative public procurement and the awareness of the market participants.
