Summary/Abstract: In this work we have done, there is an analysis of the legal issues that arise as a result of the appeal examination made on the judgment given in a lawsuit against the act of the Court of Cassation's random fire on the air judgement. An assessment will be made regarding the situation before and after the 1 June 2005 criminal code amendment on state of necessity by acting from this lawsuit.
