Summary/Abstract: The Family Law of the Republic of Serbia (hereinafter: the Law) was passed in 2005, and as such at the time when it was adopted represented a significant innovation compared to the previous Marriage and Family Relations Law from 1981. In this paper we present the current status and place of the Family Law in the legal system of the Republic of Serbia. Given the fact that since the adoption of the Law one decade passed, it would be necessary to introduce the innovations in this field. A particular problem that we emphasize is that there are legal gaps that occur due to technological development and medical devices as well as changes in the overall reality. Thus, many social phenomena remain outside the legal regulation in our country. The issue we are engaging as well are the possible solutions to the above problems.
