Summary/Abstract: Considering the fact that in the modern world the state borders represent almost no problem for the perpetrators of criminal offenses, especially for organized criminal groups, the international criminal justice cooperation (police and judiciary) became the means without which one cannot imagine effective crime countering, especially when it comes to organized crime. Contrary to the above stated we have the general principle of state sovereignty, which is especially highlighted in the application of criminal law norms. The consequences of maintaining this principle are, as far as the criminal matters are concerned, such that they unambiguously lead to numerous restrictions both in the investigative and in the trial phase and even later in terms of extradition and serving criminal sentences in another country.We are witnessing the fact that the process of limiting national sovereignty in criminal matters is being implemented within the framework of the European Union as a result of appreciation of the fact that contemporary transnational crime threatens all countries alike, and that it may be successfully combated only with joint forces. The aim of this paper is to have the institute of joint investigation teams in the European Union (EU) defined from both normative and practical perspectives, to have its capabilities demonstrated as well as advantages that it brings to the EU member states and the way in which it practically functions and how third countries (countries that are not members EU) may participate in it. The paper will also present the role of Europol and Eurojust as institutions of special importance for the EU in the fight against crime.Bosnia and Herzegovina and the Republic of Serbia are on their path towards the EU and the objective of this paper is to inform Judges, Police Investigators, Prosecutors and Academics about this important EU institute for combating transnational crime, its opportunities and obligations that will "soon" emerge before us.
