PROPERTY PROTECTION FROM ILLEGAL, “HOSTILE” ACQUISITION IN THE CONDITIONS OF THE GLOBAL FINANCIAL AND ECONOMIC RECESSION

Summary/Abstract: The article looks into the modern illegal or so-called “hostile”, “aggressive” acquisition of property and the world and the Russian practical experience in these acquisitions in the conditions of the global financial and economic recession. The research has been built on three parts – the property as an object of illegal acquisition, instruments for acquisition and analysis of property protection from these processes. An important element of the analysis is modeling of protection of property over the shares or the socalled “pyramid of participation”. The authors that work on the issues of illegal and property acquisition and transformation are pointed. The practical experience of the illegal acquisitions in the USA, Japan, England are examined, as well as the characteristics of these processes in the Russian Federation. The article is part of a bigger joint monograph of the authors and an implemented project of the National Audit Office in the Russian Federation.
