Summary/Abstract: The first part of the article presents different approaches to judge activism formed in doctrine as well as its different forms. Then follows the presentation of the background for the conflict between the supporters of judge activism and its opponents. The article concludes with the presentation of arguments justifying taking the active attitude by the judges.
