Summary/Abstract: In the conclusion of a review of the Slovenian archival legislation, we can ascert that we are generally pleased with it. There are organised legal conditions for proper working with archive and registry office mate- rial as well as law regulations by which the way and acts guaranteeing qualitative formulation of all basic principles of contemporary archival theory and practice are being thoroughly stipulated. Being every day in the field, unfortunately we have to say that the whole situation is much different. Namely, day after day we receive information published in public announcements that in spite of proper legislation, registry offices and archive material are being handled as they used to, and that they are being lost, irregularly rejected, chosen and destroyed. We are especially horrified when we realise that during the introduction of specific bankruptcy proceedings or closing down of enterprises, various moving or reorganisation and similar situations, big quantities of register and archive material are missing. Such material is being elemental destroyed and only in rare cases competent archives are being informed when it is too late. We are also surprised when we find out that a certain material is missing or the whole material appears in various substantial variants. In the end, we cite that an attitude toward archive and register material is yet changing for better based on the new legislation. The future will show whether individual articles in the law and law acts are properly, sufficiently and professionally prepared, so that their users could find an answer to asked questions, which appear in everyday archival theory and practice. Certainly, we have to be aware that the organisation of the archival service in every state starts with holders of authentic register and archive material; it starts, or if you like, is born as "the memory of the people". The one who does not take care about his written inheritance will be forgotten.
