THE SILENCE OF THE VICTIM OF DOMESTIC VIOLENCE

Summary/Abstract: The silence of the victims of gender violence crimes, due to the exemption from the duty to testify against relatives provided by article 416 Spanish criminal procedural Law, has become one of the most important obstacles for the Administration of Justice in the fight against impunity for such crimes. This circumstance has reasoned that both, the doctrine and the public organizations with responsibility in gender violence, have urged the amendment of the article excluding victim-witnesses from the privilege not to testify. The purpose of this paper is to analyze different aspects such as the nature and purpose of the article, its scope and procedural consequences posed by the absence of warning, all this in order to issue a considered opinion regarding the suitability of its reform
