Particularities of the contracts for providing medical services, medicines and medical devices

Summary/Abstract: In Romania, contractual relationships between health insurances houses and providers of health services, medicines and medical devices are governed by civil law. In the new Civil Code, the legislator felt the need to regulate – under the category of special contracts – the provision contract. Considering these aspects, I undertook a brief comparative legal analysis of the two types of contracts. The article also includes an analysis of the assignment of receivables and of the mortgage on the claims resulting from contracts for the provision of medical services and medicines.
