Some observations regarding the criteria of conditions for criminal indictment from the perspective of criminal code succession

Summary/Abstract: The succession of penal codes has generated numerous situations in which it is necessary, for the judicial institutions, to determine the more favorable criminal law. This activity can only be executed on the basis of a functional system of criteria that allows the enactment of certain solutions in accordance with the principles that govern this domain. One of those criteria regards the conditions of criminal liability. The modifications brought by the new penal Code in this regard are significant and must be fully understood by the ones who apply them, on one hand, because the intervention of such causes can lead to the abolishment of criminal liability and, on the other hand, because their effects have a large spread, being able to intervene, in some cases, even after the execution of the penal sanction.
