Summary/Abstract: The article brings to the fore a controversial issue taking into consideration that the dispositions on technical supervision have been amended and supplemented on several occasions, given the controversy in practice and literature, the wording generating different interpretations. The analysis takes into account both previous legislation and the effect – the new Code of Criminal Procedure, with emphasis on the right to privacy and the issuing of technical surveillance warrant
