Concerns of the Competition Council regarding the application’s development of legal concepts established in European level

Summary/Abstract: This article contains clarifications regarding certain issues relating to state aid rules in the context of insolvency. The analysis takes into account the provisions of the article 412 of Emergency Government Ordinance no. 77/2014 on recovery of state aid, that has given rise to several interpretations in the context of the aligning with the European Commission practice, and the two cases of insolvent companies in Romania where there are applied the state aid rules: Oltchim and Hunedoara Energy Complex.
