Summary/Abstract: Under the Article 125 of the Association Agreement between the European Union and the European Atomic Energy Community and their Member States and Georgia (the “Association Agreement”), the liberalisation of the air transport between the EU and Georgia shall be governed by the Common Aviation Area Agreement between the European Union and its Member States and Georgia (“EU CAA”). EU CAA establishes a common aviation area between the EU and Georgia. Through creation of common aviation area, it aims to provide with mutual market access to the air transport markets of the parties, with equal conditions of competition and respect for the same rules, including in the areas of safety, security, air traffic management, and environmental regulation. Importantly, the Annexes of EU CAA list the body of EU aviation legislation with which Georgia is obliged to harmonize its legislation in due course. At the same time, Georgia has bilateral air service agreements (the “Air Service Agreements”) with several EU Member States, most of these agreements being concluded prior to EU CAA. The goal of the paper is to assess the current status of approximation of Georgian aviation legislation with that of EU law. The paper will try to identify the gaps in the Georgian legislation and the outstanding pieces of EU law the approximation of which is still pending. The effect of any pending approximation will be also assessed. At the same time, the paper will touch upon on the issue of interrelation between EU CAA and Air Service Agreements
