Summary/Abstract: As long as the accused held the position of a coordinating manager of the Directorate for Agriculture and Rural Development, that is a remunerated position within the public entity, he had the capacity as a public servant, in the sense given to it by the criminal law, so he could be a qualified active subject of the conflict of interest offence. The ”public servant” notion in the sense ascribed to it by the criminal law is different from the one ascribed to it in the administrative legislation.
