Summary/Abstract: The nineteenth century was marked by the adoption of civil codification in Europe. Perhaps it is a little surprising, but the fact is that with its Civil Code, the Serbia was the fourth country in Europe that adopted the Code. In this paper, the author tries to explain why and how they came up with the idea of making Code, Code origins, the selection of originals, as well as the position of Serbian Civil Code among European codification. Having in mind the fact that the Serbian Civil Code is commonly referred to as a shortened version of the Austrian Civil Code, it will be presented as the series of facts which indicate that this conclusion is not entirely true, but there are significant deviations from the original, as well as some other solutions. It will be pointed out the influence and significance of the Serbian Civil Code.
