Summary/Abstract: The ICCJ's recent decision no. 23/2017 impose the reconsideration of the conditions required for the interested party to request the court to issue a decision to place a contract of sale. The present study aims to synthesise the unilateral promise of sale or purchase and the bilateral promise of sale, insisting on the legal actions made available to the interested party in case of non-fulfillment of the obligations assumed by the promise of sale, namely the action having the object of obtaining a court decision to place a contract of sale, the resolution of the promise with damages or the action for obtaing the damages.
