Summary/Abstract: W artykule zaprezentowano najważniejsze nowe regulacje dotyczące pośrednictwa kredytu hipotecznego wynikające z implementacji dyrektywy hipotecznej do polskiego porządku prawnego. W pierwszej części artykułu zidentyfikowano przyczyny podjęcia prac nad dyrektywą hipoteczną. W kolejnych rozdziałach przedstawiono skalę pośrednictwa kredytowego i dotychczasowe regulacje, a następnie najważniejsze zmiany wynikające z tej dyrektywy: rejestr pośredników kredytowych i warunki, które należy spełnić, aby być do niego wpisanym, nadzór KNF, wymogi w zakresie wiedzy i kompetencji oraz obowiązek posiadania polisy odpowiedzialności cywilnej. Hipoteza artykułu jest sformułowana następująco: wprowadzone przez unijne regulacje zmiany w obszarze finansowania hipotecznego konsumentów mają zwiększyć odpowiedzialność za zadłużenie zarówno kredytodawców, klientów, jak i pośredników kredytowych. Artykuł powstał z wykorzystaniem aktualnej literatury przedmiotu oraz w oparciu o analizę danych statystycznych. The article presents the key new regulations concerning mortgage credit intermediation resulting from the implementation of the Mortgage Credit Directive to the Polish legal order. The first part of the article identifies the reasons for undertaking works on the Mortgage Credit Directive. The following chapters detail the scale and the regulation of mortgage intermediation in Poland and the changes resulting from the Directive: the credit intermediary register and the conditions to be fulfilled to be entered into it, the KNF (Polish Financial Supervision Authority) supervision, the knowledge and competence requirements as well as the obligation to have a civil liability policy. The article is based on the current literature covering this area and the available statistical data. The following hypothesis is being debated upon throughout the article: the amendments introduced by EU regulations in the field of consumer mortgage financing shall increase the liability of credit providers, clients and credit intermediaries.
