Summary/Abstract: Instytucja ubezpieczeniowego regresu nietypowego była wielokrotnie przedmiotem zarówno orzecznictwa sądów, jak i wypowiedzi przedstawicieli nauki prawa. Właściwe określenie terminu przedawnienia tych roszczeń regresowych ma duże znaczenie praktyczne tak dla towarzystw ubezpieczeń, jak i podmiotów mogących stać się dłużnikami w postępowaniu regresowym. Stosunkowo długo brak było zgody co do określenia, w jakim terminie przedawniają się tego typu roszczenia. Zagadnienie to budziło dużo kontrowersji zarówno wśród przedstawicieli doktryny, jak i w orzecznictwie. Istniejącej w piśmiennictwie różnorodności poglądów sprzyjały liczne zmiany przepisów regulujących kwestię obowiązkowych ubezpieczeń komunikacyjnych, stanowiących podstawę do analizy terminów przedawnienia nietypowego roszczenia regresowego ubezpieczyciela. Spośród wielu warto odnotować podgląd, w myśl którego roszczenia te wynikają z umowy ubezpieczenia i przedawniają się w terminach przewidzianych dla roszczeń z niej wynikających. Wśród przedstawicieli doktryny pojawiło się także stanowisko, zgodnie z którym nietypowe roszczenie regresowe jest roszczeniem związanym z prowadzeniem przez ubezpieczyciela działalności gospodarczej i w konsekwencji winno się przedawniać w terminach przewidzianych dla tego typu roszczeń. W literaturze tematu zaakcentowane zostało także stanowisko, iż termin przedawnienia omawianych roszczeń powinien być ustalany w sposób analogiczny do terminu przedawnienia roszczenia z tytułu regresu zwykłego, a zatem zgodnie z terminami przewidzianymi dla poszkodowanych. Z kolei teoria podkreślająca, iż roszczenie regresowe nietypowe jest roszczeniem w pełni samoistnym, nowym, wynikającym z przepisu prawa, wskazuje jako właściwe dla określenia terminu przedawnienia omawianego roszczenia zawarte w kodeksie cywilnym przepisy lex generalis, z art. 118 k.c. na czele. Za niebudzące wątpliwości uznać należy, iż roszczenie to staje się wymagalne z chwilą wypłaty odszkodowania i tym samym zmaterializowania się odpowiedzialności gwarancyjnej ubezpieczyciela. Niniejsze opracowanie poddaje analizie kwestię przedawnienia nietypowych roszczeń regresowych ubezpieczycieli oraz stanowi swoiste podsumowanie stanowisk prezentowanych przez przedstawicieli doktryny i orzecznictwo w tym zakresie. A notion of an unusual insurance recourse was many times a subject of analysis by both court decisions and statements of legal science representatives . Proper definition of limitation period of recourse claims is of significant practical importance for insurance companies and entities that may become debtors in recovery proceedings. For a relatively long time there was no consensus as to determination of limitation period for this type of claim. This issue aroused much controversy among representatives of the doctrine and case law. Clearly visible diversity of views in the literature favored numerous changes in regulations governing the issue of compulsory vehicle insurance which is a basis for the analysis of limitation periods of insurer’s unusual recourse claim. A view that should be noted from among them is that the claims arise from the insurance contract and shall expire in time limits provided for claims in the document. Among the representatives of the doctrine, there is a noticeable standpoint according to which the unusual recourse claims result from the insurer’s business conduct and as a consequence, should expire in the time limits provided for such claims. In the literature it was emphasized that limitation period for these claims should be determined in the same way as the period of limitation for claim arising from the normal recourse, so in accordance with the deadlines provided for the injured parties. On the other hand, the theory emphasizing that the unusual subrogation claim is a new and fully self-contained claim, resulting from the provision of law, indicates the rules applicable for determining the limitation period in generally applied Civil Code regulations, with article 118 of the Civil Code as the crucial one. It shall be unquestionable that the claim becomes due upon payment of compensation and at the same time materialization of insurer’s warranty liability. The article examines the limitation issue of insurer’s unusual subrogation claims. It provides a synthesis of the positions presented by representatives of the doctrine and jurisprudence in this area.
