Legal nature and effects of the Paulian action in the present and the previous Civil Code

Summary/Abstract: This study analyses the legal nature and effects of the Paulian (revocatory) action, both under the Romanian Civil Code of 1864 and under the present Civil Code (of 2009), following its evolution from the inspirational departure point which has been the French Civil Code as developed by French doctrine and case-law. Relevant Romanian doctrine is presented, as well as several court decisions. Changes brought by the Civil Code of 2009 are emphasized. Finally, an enumeration of all changes brought to the Paulian action by the current civil legislation is presented.
