Summary/Abstract: The right of private property has been one of the fundamental rights knownsince the ancient antiquity. The rights of individual ownership were first treated in thephilosophical ideas of Russeau, Lock, Hobbes and other philosophers who focued onprivate property. The institutionalization of this particular right coincides with its formalizationin various important legal documents. The Republic of Albania has treated the privateproperty in various forms, depending on the political systems, which, throughout history, canbe found in various forms including the following: an empire during the period of theOttoman occupation, a monarchy, in the form of a communist totalitarian regime, andeventually that of a democratic society. The institution of property in Albania, as well as thewhole judicial system is based on the Roman-German system (civil law), which is the majorsource of the right. The European Union, along with its mechanisms and institutions isplaying a primary role in the solution of the problems that have to do with the privateproperty in the Republic of Albania. The commonalities that all political systems have withregard to private property have to be found in the most important legal documents such ascharters, constitutions and laws regarding the fundamental rights and freedom of individuals
