Summary/Abstract: Nowadays tourism through its role represents an extremely important area ofthe national economy. As a priority area of the national economy, it should benefit froma similar legislation. The tourism activity cannot be conceived outside the legal andethical framework. Unfortunately, the current regulation is not a solution to thedevelopment, organization and growth of tourism in Romania.The paper analyses the legal regulation in the tourism area in direct relationto the Government Ordinance no. 58/1998, but also through a comparative analysiswith the Bill concerning the Tourism Law.Therefore, both the domestic and international regulations take intoconsideration three factors to qualify tourism: a geographical factor (the usualenvironment refers to the tourist’s domicile or residence, by case), a temporal factor (itrefers to the travelling period) and a factor aimed at the purpose, the reason ofconducting specific activities (it refers to any non-pecuniary activity within the visitedlocation, which obviously excludes from this sphere any activity that would be carriedout under legal labor relations, without including volunteering service in this category,for example visiting cities, attending scientific conferences or various cultural andsporting events and festivals, visits to relatives and friends, trips, business, etc.).The Romanian school system is confronting with difficulties in organizations ofextracurricular activities and the percentage of the teachers and institutions who use1 Senior Lecturer Ph.D., Faculty of Economic Sciences and Law, University of Pitesti(Romania), andidraghici@yahoo.com2 Lecturer Ph.D., Faculty of Economic Sciences and Law, University of Pitesti(Romania), lavinia_olah@yahoo.com29this form of education is low represented. In this paper we analyze, also, legislativeaspects of the organization of extracurricular activities - tourism (as a form of nonformaleducation) in the pedagogical process who is not finished at the end of thescholar day or at the end of the scholar year. The tourism is one way of practice theextracurricular activities, a way of non-formal learning. Non-formal education comingto complement, support or as a source of valorization of the learning experiencesformally acquired.
