Does an Employer have the Right to Monitor Employee E-mail?

Summary/Abstract: In the 21st century it became common that electronic mail is used in the workplace as a very economical way to communicate and share information. However, such technological advancement presents new issues of employee privacy because the employees treat e-mail like private but a growing number of the employers report monitoring employee’s e-mail as they believe that anything created by an employee while at work is subject to control. The problem is that there exists no clear concept defining the extent of the employee privacy rights as they relate to the workplace. The purpose of this article was to confirm or deny the hypothesis that the employer has the right to monitor the employee's e-mail. The research done in the United States, European Union and Lithuanian law systems gave different results. (...)
