Summary/Abstract: For many years, a conflict concerning the justification for human rights has permeated philosophical debate. According to Habermas, human rights are a realistic utopia, since the aim, which is building a just society, is an inherent element within institutions of constitutional countries. The philosopher points to the double face of human rights, i.e. the legal and moral aspect. According to Habermas, human rights should not be the issue of politics but should be introduced into laws and procedures. To fulfill this goal, the philosopher proposes creating „a global union of citizens” based on the concept of human rights, consisting of three levels: national, transnational, and postnational.
