Summary/Abstract: The article analyses thе legal rules concerning the procedural condition for lodging a civil claim on confiscation of illegally acquired property in favor of the State in light of the controversial practice of the Supreme Court on the question: whether a hanging criminal procedure for prosecuting someone about crime committed upon art. 22, para 1 ZOPDNPI is a procedural condition for lodging a civil claim on confiscation of illegally acquired property, or not. The analysis shows that the presence of such procedure is not a procedural condition.
