Summary/Abstract: Due to the subject matter, the article presents in detail the structure of notariate according to the Constitutional Tribunal jurisdiction (Constitution of 2 April 1997). Pursuant to Article 1 of the Law of 14 February 1991, Law on the Notariate, notaries shall be appointed to conduct legal transactions which the parties to such transactions have to or wish to notarise. Authors lay out the interplay between the position of the notary (civil law notary) as the public confidence person and independent profession.
